South Africa's supreme judicial authority has without dissent decided that all parents of newborn children are entitled to equal parenting time - a historic judgment hailed as a major victory for gender equality and family rights.

Present Legislative Disparity

Under the present regulations, female parents are allowed one-third of a year of time off, while fathers get merely a brief period.

Through its decision, the supreme tribunal declared portions of the law unconstitutional, labeling it discriminatory against dads, and ruled that mothers and fathers may now share the allocated time off however they choose.

"This constitutes a pioneering step for fairness, household welfare, and the prospects of parenting in the country," stated Sthembiso Phakathi, creator of a fathers' organization.

Court History

Last year, a inferior tribunal determined particular parts of the work regulations and the Unemployment Insurance Fund Act inequitable and ruled that they infringed upon the privileges of multiple parental arrangements.

The provincial court then determined that the regulation discriminated against categories of caregivers differently regarding the duration of parenting time and unemployment benefits obtained.

The applicants contended that the present regulations treated unequally against mothers and fathers who were other than the biological mother - specifically, dads, foster caregivers, and caregivers of children born to substitute mothers - by providing them only 10 days of parenting time, while the biological mother was granted 120 days.

Legal Explanation

Revealing the decision on Friday, Justice Zukisa Tshiqi declared that both parents should be granted divide the allocated time as they considered suitable, describing the existing legislation outdated and one which "unequally pressured female parents and marginalized dads".

"The protection of birth mothers to the elimination of additional caregivers has the detrimental effect of continuing the belief that females are, and should be, the main guardians of babies.

"The father is sidelined and prevented from the chance to participate as a guardian in the rearing of the newborn during the initial period of life," she stated further.

Judge Tshiqi stated the decision was not merely about fair treatment but also about safeguarding the dignity of households, emphasising that the ultimate focus of the court's decision was the health of infants.

"The unequal treatment not just sidelines caregivers but also deprives infants of the possibility to be with their caregivers during a crucial period of nurturing and adaptation to their new environment."

Feedback and Consequences

The petitioners celebrated the ruling, while attorneys advised that the decision would have major ramifications for companies, who will need to adjust their existing absence rules to follow the decision.

"The essence of the case is that it underscores the requirement to offer identical caregiver entitlements, acknowledging that raising an infant is a collective task," an official from the Commission for Gender Equality informed media outlets.

He commented the present regulations "failed to represent changing cultural attitudes around child-rearing".

Execution Timeline

The judicial body has postponed its determination of illegality for three years, giving parliament chance to change the current laws to comply with its judgement.

Meanwhile, mothers and fathers will be granted choose how they choose to share the allocated time of absence.

In cases where a single guardian is has a job, that caregiver may utilize the complete time off allowance.
